The condition of entry into force of the Protocol was one of the major topics discussed at the thirty-eighth session of the thirty-eight. Delegations debated and considered the manner from a viewpoint of both co-ordination with existing conventions for slop safety or pollution prevention adopted by IMO, and necessity of entry into force in a reasonable period of time.
2 Given the importance of including the factor of merchant fleet volume, Japan would like to propose the following alternative text inspired by Article 15 of the International Convention for the Prevention of Pollution of the Sea by Oil, 1954 and Article 15 of the International Convention on Civil Liability for Oil Pollution Damage.(Figures in the square brackets below should be considered indicative and not constitute a formal proposal of Japan).
.1 The present Protocol shall enter into force twelve months after the date on which [fifteen] States including [seven] States each with not less than [5,000,000] gross tons of merchant fleet tonnage have become Parties to it in accordance with article 5 of the present Protocol.

Comments on the Draft Protocol of 1997 to amend the International Convention for the Prevention (if Pollution from Ships, 1973, its modified by the Protocol of 1978 relating thereto

Executive summary: Japan would like to make some comments on the Draft Protocol of 1997 concerning retroactive application of NOx emission control for existing ships and application of survey and inspection.

Application of the regulation of Nitrogen Oxides (NOx) emission control for existing ships
2 In the current text of regulation 13(1)(a), concerning nitrogen oxides(NOx) emission control applies to each diesel engine installed on a ship constructed on or after 1 January 2000 and each diesel engine which undergoes a major conversion on or after 1 January 2000. Therefore, this regulation applies to the ships which exist at the time of entry into force of this Protocol.
3 Although Japan recognizes the necessity of fully applying the provisions regarding NOx emission control to existing ships, Japan proposes to amend regulation 13(1)(a) as follows for the reasons mentioned in paragraph 4 below.
Draft subparagraph (1)(a) of regulation 13 should be replaced by:
"(a)This regulation shall apply to
(i)each diesel engine with a power output of more than 13(1 kW which is installed on a ship constructed on or after the date of entry into force of this Annex,
(ii) each diesel engine with a power output of more than 130 kW which undergoes a major conversion after the date of entry into force of this Annex,
